How is doing something (which I think is) harmful to me "other
people's
business"?
Exactly. I think they went a bit too far but so did the old biddy. Why
interfere for no apparent reason? But shoving her in the way of a
train? Nah.

Ah but statistically he balck is more likely to attack up, certainly more
likely
to harmyou than second hand smoke, but you can't say that these days, they
are a protected minority with human rights. The smoker of course has
had his human rights removed so you can surpress them as much as you like.

Is it actually illegal to smoke in the open air on a train station.

Is there a specific by-law - or can anyone designate an area as a no
smoking area and then it becomes illegal to smoke there - eg grounds
of a hospital?

Yes. Most (all?) railway stations were made non-smoking at the same time
as the smoking ban but the outside bit is only covered by railway
bylaws.

Do you know where in the railway by-laws - I've looked and I can't
find it online.

Or is it just relying on the old:

"No person shall smoke or carry a lighted pipe, cigar, cigarette,
match, lighter or other lighted item on any part of the railway on or
near which there is a notice indicating that smoking is not allowed."

or is there a new specific by-law?

Are you saying that is all that is needed?

What if there isn't a sign on a particular platform - is it then
permitted there?

Fuck knows.

I lit up the other day and the porter told me "Dude, you shouldn't smoke on
the platform. There are plain clothes coppers who will nick you for it."

Good enough for me, but then I'm a simple chap with basic needs.

If there is a no smoking sign, then you don't smoke. Is that too

That one seems to cover it already, if there's a sign saying "No smoking
in any part of this station". And as they now do have such signs...

"While the legislation affects covered or partially-covered premises,
the railways are using existing railway bye-laws to extend the
smoke-free environment to all uncovered platforms and footbridges for
 reasons of practicality and simplicity."

Last week my wife was in that part of the country and was on a bus in
the north west Kent area. A woman came down the stairs and spoke to the
driver, before plonking herself down next to my wife, saying, "There's a
guy upstairs smoking. I've told the driver but I bet he does bugger all
about it." Another passenger complained, but still the bus carried on
with nothing being done.

My wife was quite indignant about it, but I did explain to her that if a
druggie was in that desperate for a fix it is highly unlikely that a
request from the bus driver would be heeded and, indeed, it is far more
likely that the bus driver would be attacked for daring to mention it.
In such circumstances, I asked, how many of the passengers did she think
would go to the aid of the bus driver?

She did concede that it could have been a problem and, when yesterday's
news appeared, actually linked the two incidents.

Usually there is a sign at the entrance to the station premises which
states that "Smoking is not permitted in this station", which is usually
backed up by signs, which have pictures for those who can't read, on the
platforms.

Yesterday on two open to the air stations, Nailsea and Backwell in
Somerset and Cosford in Shropshire, I observed such signs, as well as at
Birmingham New Street.

Perhaps you can advise on now Bus Stations - my local Bus Station has
a sign which says "Smoking is not allowed in this bus station".

Now with your fine legal mind - would I be breaking the law if I were
to smoke in the open air in that bus-station? Does this sign have any
legal standing whatsoever?

I smoke there regularly and ignore any jobsworth (or rabid passenger)
who tells me not to.

Are you a rabid non-smoker?

There may well be by-laws which prohibit smoking, which would make it
illegal.

Ah yes the classic answer.

His wife said that he died from secondary smoking - therefore he did.

Perhaps you can point us to any scientific evidence that Roy Castle -
or indeed anyone else - has died from secondary smoking.

He died from a form of cancer which can only be developed from tobacco
smoke.

That's fine, I am quite happy to have smokers only buses.

Not as such but for someone to have died of lung cancer - and never
having smoked in his life - makes the whole thing suspicious.

I know, I have to "run the gauntlet" of about 30 people smoking outside
our tobacco free premises every morning when I go to work. I've learned
to hold my breath, its as bad as it used to be on the train in the days
when they had one smoking carriage.

It wasn't just his wife who said that he died of secondary smoke, he
said it himself. Since he lived for 2.5 years after he was diagnosed
with lung cancer he had lots of chances so to do. What she did was
campaign for the smoking ban which we now have.

I trust you can point to some other cause of lung cancer. The only one I
can think of is related to coal mining, and he never did that.

Asbestos but that causes another specific form of cancer in the lung,
mesothelioma, the type he had is generally agreed to be caused by tobacco
smoke. (Except by pro smokers)

Of course all this doesn't mean Mr Castle "got" lung Cancer due to
"secondary smoking" but it does show that there are lots of other causes.

I'm all for Smoker only buses, especially on the Brighton&Hove

I didn't include this since the medical indications are quite different.
You can also get lung cancer from radon exposure - very area specific
this one, note for Duhg, not related to nuclear power stations - or
pollution - you can have that one Duhg.

Its reckoned that one way or another around *80%* of cases are smoking
related. As they say: "Prevention is the most cost-effective means of
fighting lung cancer" and the way to prevent it is to ban smoking.

Not "lots of" - a few. And as I've said at least *80%* of cases of lung
cancer are smoking related. Probably more than that TBH.

For "quick and dirty" it suffices if I really cared about different
forms/causes of lung cancer (rather than lung cancer itself)would do

I'm with you there. I'm not a lover of nanny state rulings either, but
smoking isn't good for anyone - especially the people who do it. We've
known that for a long time, since 1950 to be exact.

The problem here is that there is a *huge* and very powerful tobacco
lobby so in a sense the nanny state rulings are the only available
counterweight to that. This has been shown many times with the court
cases in the USA.

As was recently shown on TV in a program made by Duncan Bannatyne they
are now working hard to expand their market (at the cost of people's
health and shortening people's lives) in Africa as we speak.

As what? Tobacco smoke? Its been agreed that there are probably five
causes of lung cancer recognised as lung cancer, but over 80% of those
are caused by smoking.

In a strict sense, if you mean there is no form of cancer which can be
developed from tobacco smoke you have a point.

Aren't there supposed to be rules about how far from the door smoking is
allowed. I was under that impression, not that I require a law to prevent
me from being a pain in the arse to non-smokers since I am neither a
moron nor a twat (at least not in that respect).

What you should ask "the management" for is a decent size outdoor ashtray
to be placed outside of the building a few metres away from the doors,
and then to institute a get tough policy on people
