STOCKTON - Four people arrested in a shootout at Louis Park that left
a 13-year-old boy dead early this year will stand trial on charges
that include murder and street terrorism, a San Joaquin County
Superior Court judge ruled Monday.

Prosecutors now are considering if they will seek a death sentence
against two of the defendants charged with killing Aaron Kelly Jr. on
Feb. 8 as his mother drove him and her two young daughters away from
the suspected gang clash.


"That's something that will be decided as proceedings go on," San
Joaquin County Deputy District Attorney Janet Smith said.

She said she should know by the defendants' next courtroom hearing,
set for Aug. 11.

"This is really just the beginning of the process," Smith said. "We do
have a ways to go."

If convicted, Chanreasmey Prum, 22, and Michael Garduno, 19, face a
possible death sentence, while Rattany Uy, 17, and Deandre Cole, 17,
could spend a maximum of life in prison because they are juveniles.
The Record is naming the juvenile defendants because they are being
tried as adults.

San Joaquin County Superior Court Judge George J. Abdallah Jr.
listened to nine days' worth of witnesses called during the
preliminary hearing before ruling that the four should stand trial.

Abdallah also ordered each of the four be tried with the attempted
murder of Kelly's mother, Renee Garcia, and her daughters along with
the charge of shooting into an occupied vehicle.

Prum also is charged as being a convicted felon in possession of a
firearm.

Prum and Uy are accused of approaching and threatening Jonathan Tellez
Jr. and his father, 40-year-old Jonathan Tellez Sr. - who is dating
Garcia - while they, along with Kelly, were hanging out near the boat
ramps at Louis Park. Feeling threatened, the group left, and shots
rang out.

Kelly was killed when a single bullet grazed his mother's arm and hit
his chest as he rode in the car's front passenger seat.

In separate interviews with The Record shortly after their arrests,
Prum and Garduno denied their parts in Kelly's death. Garduno said he
and Cole, his cousin, were simply getting a ride from Prum when they
were unwittingly embroiled in the killing.

Smith, the prosecutor, said more details would come out in the trial,
but she declined to elaborate.

During Monday's hearing, several of Kelly's relatives sat quietly in
court. They wore round pins on their shirts with a picture of a
smiling Kelly.

On the opposite side of the courtroom sat several supporters of the
four defendants, including Prum's older sister, Srey Blevins. She said
she was confused by the court process and is putting her faith in
Prum's court-appointed attorney, Sam Behar.

"He's got a good lawyer," she said. "He's just so lucky."
