Gillick Problem
Can anyone provide me with any help on this one please?
My grandson has made two serious attempts at suicide (really deep cuts
to both wrists) He is just 17 and was admitted to a psychiatric ward
for adolescents and asked that his parents should not provided with
any information. He was then discharged and provide with
accommodation with a housing trust but then re-admitted to the
psychiatric ward after a couple of weeks but the staff involved say
they cannot tell his worried parents how he is but agree that this is
not right.
Gillick says that he can make his own decisions about his treatment if
he is able and they have accepted that he is 'Gillik competent' but he
is obviously not acting rationally. Because he is directing his own
treatment they have decided to allow him confidentiality but the
Children Act says that decisions must be made in his best interest but
no one appears to be looking after his interest other than the
provision of treatment.
Social Services say that he is not their responsibility because the
health services are treating him although it was they who organised
the accommodation from which he was re-admitted.
In a nut-shell no one is accepting responsibility for caring for a 17
year old who has led a sheltered middle-class life, is by no means
'street wise' and has serious psychological problems. His caring
parents would like to, at a distance if that is what he wants, but
cannot because no one will tell them what is going on.
