Failed Incapacity Claim   
Hello all,

Just a quick question if a Incapacity Benefit Claim get Rejected is there 
anything else that can be claimed while the Appeal procedure takes place.. 
Income support maybe ?

How do you mean by rejected? Rejected at the outset (ie on an initial 
claim without any payment being made) or rejected after a personal 
capability assessment (ie a medical). If the former, why was it rejected?

Income Support can be claimed if the claim was ended due to failing a 
medical so long as the person is going through the appeal process. But 
if the IB claim was rejected at the outset it depends on why it was 
rejected. If insufficient contributions then yes, IS may be claimed but 
for any other reason it will depend - you may need to claim Job Seekers 
Allowance instead.

If your friend has attended a medical and has been refused IB because of 
  failing the personal capability assessment (ie what used to be called 
being found fit for work) then the two options are:

1. claim Job Seekers Allowance - this will not affect the outcome of any 
appeal. If entitled benefit will be paid in full.

2. claim Income Support - however this is paid at a reduced rate until 
the appeal has been heard. The amount paid is 80% of the usual Income 
Support rate with no disability premium. If aged 25+ this will be about 
£48 per week, under 25 it will be less.

However, Income Support is means tested - her income and savings are 
taken into account and if she has a partner then the income of the 
partner will be taken into account. If the partner works full time 
Income Support may not be paid, depending on hours worked.

If your friend has any other way of being entitled to Income Support 
then it will not be reduced (eg if she is a lone parent).
