Sir Elton John BARRED from adopting little Lev... he's too old and gay 
weddings don't count, says Ukrainian minister

Elton John's hopes of becoming an adoptive father to a 14-month-old boy 
were ruled out last night.

Ukraine family minister Yuriy Pavlenko declared that gay couples were 
judged not suitable to adopt children under his country's law.

At the same time, Mr Pavlenko stressed there must be an age gap of no more 
than 45 years between a child and its adoptive parents.

At 62, that rules Sir Elton out. Even if his much younger partner, David 
Furnish, was approved as a suitable adoptive parent, at 47 next month, he 
is also too old.

And in a third rebuff, it emerged that the boy's mother has not waived her 
parental rights, so the child is not even formally on the adoption list.

'Foreign citizens who are single have no right to adopt children,' Mr 
Pavlenko said. 

And the age difference between the adopter and the child cannot be more 
than 45 years.

'The law is the same for everybody: for a president, for a minister, for 
Elton John.'

Mr Pavlenko also said that adoptive parents must be married. Ukraine does 
not recognise that homosexual partnerships are the same as marriage.

Any attempt to change this could face a backlash from both the Orthodox and 
Catholic churches in Ukraine.

Sir Elton and Mr Furnish entered into a civil partnership in 2005. The 
couple met the boy, Lev, on Saturday at an orphanage for children of HIV-
positive parents near Donetsk in eastern Ukraine.

'David always wanted to adopt a child and I always said no because I am 62 
and I think because of the travelling I do and the life I have, maybe it 
wouldn't be fair for the child,' Sir Elton said afterwards.

'But having seen Lev today, I would love to adopt him. I don't know how we 
do that but he has stolen my heart.'

If he had been allowed to adopt Lev, Sir Elton would have been obliged to 
take Lev's brother, who is also in care.

Despite the government's intervention, the singer received support from the 
orphanage in Makeyevka.

'We liked Elton when he was visiting our orphanage, he was very impressive 
indeed, and in theory if he wanted to adopt one of our children, we would 
be happy, even though I doubt it will be possible,' said spokesman Viktor 
Goncharov.. 

'We are happy when our children go to the families. Within the last three 
years 22 children from our orphanage were either adopted or given to foster 
families.'

However baby Lev, it seems, is not really an orphan. His mother, who is 
said to be HIV positive, could still exercise her right to raise the child, 
subject to approval by social services. Lev's absent father or grandparents 
might do the same.

Mr Pavlenko said Ukraine was grateful for the singer's charity work in the 
country. He hoped Sir Elton's desire to adopt would encourage more 
Ukrainians to adopt children with health problems.

Yesterday Elton John and David Furnish's spokesman would not comment, 
saying they had 'nothing more to add'.
