Pet Owners Must Keep Pet Diaries
Are you keeping a diary of your pets daily routine and medications?
According to the Pet Care Trust PCT you should be or you may fall foul
of the new Animal Welfare Bill, (AWB).

According to the Trust the Bill will mean that anyone caring for an
animal, whether a pet owner, pet business, sanctuary or hobby club, must
keep records for up to 3 years to ensure they have fulfilled their duty
of care.

The Trusts says that for pet owners, the challenge of the new Bill will
be to diarise their pet's care routine and keep vet bills and any
similar documentation that can be considered contemporaneous
documentation. The requirement to keep 3 year records will be
particularly burdensome on pet shops and pet care businesses.

Janet Nunn, CEO, PCT met up with Tory leader David Cameron, on at a pet
shop in Witney on Friday to discuss the Animal Welfare Bill. Mr Cameron
was visiting Graham Mills Director of Buttercross Exotic Pets, a pet
shop in his constituency.

Speaking after the meeting, Ms Nunn said:

"David Cameron was very sympathetic to hear of the new burdens that the
Bill will impose on pet retailers and other pet care businesses. He
understood that the Pet Care Trust and it's members supported the new
duty of care. He was also puzzled as to why the period within which a
prosecutor may bring a case is to be extended from the current six
months to three years."

Section 27 of the proposed Animal Welfare Bill allows a prosecutor to
bring a case within six months of having sufficient evidence to bring a
case, but up to three years from commission of the offence.

"This is far too long, given that animal welfare is at stake," said Ms
Nunn. "The Trust believes the three year period should be shortened to
twelve months. For a pet retailer to show he has exercised all due
diligence under the new Bills duty of care the business will need to
keep all paperwork that proves he checked the customer was over 16 and
understood the care implications. At the moment, retailers would keep
their sales register details for 6 to 12 months this will routinely have
to be 3 years and under lock and key under the data protection act. How
many of the nations pet shops will have the space for this extra
paperwork?"

a pet owner you do not want and indeed fear for your animals lives and
safety under this animal welfare bill.

Trouble is that there are reasons to think that various pressure groups 
will try to use the new laws to make it very difficult to keep some 
classes of pets, most notably exotic species.

I would ignore them. Such a trifling misdemeanour would never warrant a 
custodial sentence, only a fine, and fines no longer have to be paid.

Some years ago during the Major administration, treasury sponsored a 
criminal justice bill that gave courts the power to fine miscreants 
according to their income. A disaster because the machinery to check on 
defendants' claims, court bailiffs etc, had been scrapped as a result of 
treasury pressure. In my case, by choosing a favourable time-slice when 
determining my income, I got off with a derisory fine for minor motoring 
offence.

The loss of court police means that fines no longer have to be paid. 
Computer-generated letters threatening prosecution are ignored by 
non-payers. They simply bin them. The only way to get them to court is 
to send out the police to arrest them and haul them into custody for a 
court appearance or, more likely, a caution! This doesn't work because 
in court the miscreant is fined, asks for time to pay, which has to be 
granted because there's no law that requires people to attend court with 
money on them, and the merry merry-go-round starts all over again.

Recently Sussex Police launched one of their occasional so-called 
crackdowns to collect unpaid fines. It was covered on a TV programme, 
Southern Ways. A camera crew followed a police patrol around who managed 
to get a couple of cheques out of miscreants for unpaid fines. Close-up 
of two cheques with names pixellated out to protect the guilty. Cut to 
senior police officer proudly trumpeting that: 'this sends a clear 
message saying that non-payment of fines won't be tolerated'. Cut to 
piece-to-camera wrap by reporter to say that one of the cheques bounced 
and the other one, for about GBP60 wasn't likely to make much of a 
difference to the region's GBP6M outstanding in unpaid fines, and that 
the police couldn't say when the next 'crackdown' on unpaid fines would 
be.

History is now repeating itself. The CSA is to lose its power to collect 
money. The work will be 'out-sourced' to private bailiff companies. This 
was exactly the same reason given some years ago for scrapping the court 
police. All part of improving efficiency.
