Costs from car fault - worth pursuing?
I bought a new car nearly 6 months ago and after 2 months it developed a
fault with the emissions control system that caused it to use more fuel than
it should otherwise have done. [1]
The garage accept that it's faulty and accept that it will have used more
fuel as a result but it's taken far too long (IMO) to resolve as the fix had
to come from the manufacturer.
It's going in to be done tomorrow [2] so should soon be fixed and working as
normal.
I will be asking the dealers to reimburse me for the extra fuel costs which
a quick guesstimate says are about £80 to £100 but if they tell me to bugger
off , how far do you reckon it's worth chasing.
I know quoted MPG figures aren't a guarantee of what each particular driver
will get, but over the first 4000 miles as the car was run in I did just
start to get what they claimed I should. Once the fault started there was a
noticable drop in economy and I'm expecting a similar sized increase
afterwards. I've also logged the amount and cost of the fuel that's gone in
there since I've had it so have fairly good evidence that more fuel has been
used.
The more questionable thing is are the dealers liable for a consequential
loss , as a result of their inability to make a prompt repair?
Would you take this to the small claims court?

[1] for those that want to know , the diesel particulate filter was trying
to regenerate much more frequently than the 800-1000km intervals than is
necessary. When it does this it dumps unburnt fuel into the exhaust to raise
temperature with a corresponding effect on MPG.
[2] Which means that if it's not fixed it I'm just inside the 6 month limit
to reject the vehicle.
