Domains after the owner dies
I have a particular interest in leonard-cheshire.com for ]political
and historical reasons.

It is currently registered to an individual,
http://whois.domaintools.com/leonard-cheshire.com James Savage, who at
some point was Leonard Cheshire's "Web editor" but died in December
2006. Note it is not registered in Leonard Cheshire's name, it is
registered in his name, and with his name as the "organization". The
domain expires in March 2013.

Currently visitors to leonard-cheshire.com are redirected to
123-reg.co.uk . I assume that this may be due to a fees issue, or
maybe because he is dead?
What I want to know is, given that it is registered in an individual's
name and that individual is dead and has been for 17 months, is there
any chance I can get my hands on the domain?

Assuming that the details in the whois database are an accurate
reflection of ownership, then title in the registration, like any
other property, now belongs to the deceased's heir(s). To know exactly
who that is would require you to have knowledge of the wording of his
will or, if he had no will, how his property was allocated under
intestacy rules.
If that is the case, then presumably the current owner has no interest
in the domain as there is now no website associated with it. They may,
therefore, be willing to sell you the domain if you are able to
contact them. Otherwise, it will become available when the
registration expires.
However, it is possible that James Savage had a contract with Leonard
Cheshire to register the domain on their behalf as their agent. If
this is the case, then they have legal title to the domain. The whois
details do not necessarily show the legal owner, merely the
registrant, and it is common for domains to be registered by
individuals or organisations acting on behalf of the contractual and
legal owner (that's how most of the "private registration" providers
work, for example). In support of this possibility, the fact that
Leonard Cheshire previously won the rights to the name in arbitration
strongly suggests that, when they gained control, they allowed or
instructed James Savage to operate it as their agent. If this is the
case, then his death has not changed the legal situation and the
domain remains their property.

James "CountB" Savage was a friend of mine, and of many other people
around this on-line community. Fantastic bloke, and he really was an
inspiration to an awful lot of us. Yes, he was Leonard Cheshire's
webmaster.
I don't know what the current state of this domain is, but I imagine
it will remain with the Leonard Cheshire organisation. It certainly
ought to - if it's in James' name, that's just paperwork. Cheshire do
have a substantial moral and legal claim over it.
I really ought to make enquiries. There's another domain that James
and I discussed for a side-project that should probably still be
pushed ahead. If you knew him, you can imagine what sort of thing it
was about. 8-)

yes, from what I've seen on his website and so on he sounds like he
was faiyly amazing, I'm sorry I never got to meet him. I think we'd
have had a lot in common - both "alternative" politically active
disabled people.
