Sky+ new contract
So we cancelled Sky 30 days ago almost because they couldn't offer us Sky+
for £49 or for FREE.

We will now be signing up to Sky again as a new customer? so will we be
eligible for any Sky+ offers?

How long are you classed as an ex-customer? My subscription ended nearly
14 months ago and I'm thinking about getting just 3 mixes and using my
old Pace Sky+ box. Would I be tied into a new 12 month contract?

I thought you only get tied into a contract if you take new equipment or
take multiroom??.

That's what I was hoping for. As Sky would have near-zero expense in
re-enabling my card, you'd think they'd be happy for any money from me.
I suppose I could phone them up...

You may be correct regarding the terms and conditions that apply to a
stand-alone viewing contract - that does not involve the supply of any
new equipment. However, I have searched the Sky website for precise
contract terms - without success.

The OP stated that he had cancelled Sky 30 days ago, because they
wouldn't offer Sky+ for £49 or for FREE. He wanted to sign up to Sky
again as a new customer - and asked whether he would be eligible for any
Sky+ offers?

The FAQs at
http://mysky.sky.com/portal/site/skycom/skyproducts/getsky/helpandquestions/returningfaqs
are not particularly helpful, although they do suggest that for previous
subscribers, Sky would reactivate the original contract. The only way
be certain is to ask Sky to send a paper copy of the contract terms that
would apply, if they agree to re-enable the card and add Sky+ functions
to the ordinary subscription. Do not rely upon anything that a call
centre operative might tell you.

Incidentally, I have subscribed to Sky and Sky+ for many years so in my
case, all minimum contract terms expired long ago. However, when Sky
replaced my Sky+ receiver last year, the box contained a copy of the
Sky+ contract terms and conditions that apply to new subscribers. The
T&Cs state clearly that Sky+ is governed by additional contract
conditions, which supplement Sky's standard terms and conditions. The
Sky+ contract also indicated that this additional service is subject to
a 12-month minimum contract period, which commences from the initial
Sky+ activation date.

A similar restriction applies to new Multiroom contracts, irrespective
of whether the underlying viewing contract has been in force for more
than 12 months.

No, only if you want to commit fraud. Re-read your contract, the bit about
"one per household", and the contract's definition of "household".

I used the My Sky contact form to ask about this and they replied that I
will not be under a 12 month contract and can cancel at any time with
one month's notice.

Great. I glad you were able to obtain a definitive answer.

And can you point me to a succesful prosecution of fraud involving
individuals applying as old customers?

So you admit it's fraud then. Just wanted to be clear.

I would suggest that the Police would not be interested, and the CPS would
laugh out loud. Civil redress maybe. Even then, i could imagine the judge
telling sky to stop being such a bunch of tossers and award then £30.

However, now that I have actually phoned them up, they say it's a
minimum12 months! They did have a record of the email but he said I
was given the wrong information. That person will no doubt be sent for
intensive re-training or simply shot in the car park in Livingston....
