Damaged Scooter saga desperation   
MSp got a letter back which was very disapointing to say the least and
as I just scraped underneath the one I have now on the Dropped? kerb
by the Post Office I sort of had a hissy fit. I bought some Glow in
the dark paint and made a RIP sign and taped it to the lampost outside
the surgery and painted all the new cracks in the pavement..

I'm not so sure that putting a RIP sign outside a health centre was 
appropriate, but having said that, I agree with your sentiments exactly.
More power to your elbow! Us folks using wheels need more folks like you 
using wheels - the sort who will not sit back and simply take whatever they 
throw at us. We must not take these things sitting down!

They are very useful if handled properly. Make as much fuss as you can
and write to anyone who will listen to you. I take it you don't have
Wheelchair Services in Scotland?

Well, nothing seems to be happening at all. I wasn't a 100% yesterday
so can't go and check what has happened but hopefully something will.
I'm not holding my breath.  However I will never use Zurich for any
products after this. Their responses border on insanity. However
yesterday Allianz Musical sent my flute insurance and I wanted the
second hand e-bay midi stuff  (adding if cheap) and they said because
I had never claimed at all on my policy that I could insure it for
£2.00 extra a year and it would be covered up to £1000. That is good
insurance. Keep the customer happy and they will come back and
recommend. So slightly happier.

I am not sure how things work in Scotland but in England I would
persue the LA as it them you have a claim against. If their insurance
will not pay out it is their problem as you claim is not against the
insurance company but against the LA.

Sorry to here that things are not sorted out yet. I was unwell and couldn't 
follow up the thread.
I had a little thought - perhaps you could claim through the Small Claims 
Court.
This allows claims of up to £750 for such things as that. In Scottish courts 
it is different from English law. See here -

That's a bit long so be careful you get the whole like on one line.

The Small Claims thing is very straight forward and easy. In most cases the 
person being claimed against never knows about it until the verdict is 
delivered and they have to pay up. It means the local authority could get 
the bill without their smart arsed lawyers even being involved.

Had a visit from the police today. Apparently the council don't want
to press any charges and the police aren't taking the matter any
further. Police  advised me to go down the legal route virtually.  I
may try to see whether this is possible after I see whether the Local
newspaper does anything with the pictures they asked for.


No idea what to do but am starting a playwriting course next week so
maybe i can think of a way of  writing a play about it.

Hi Temperance, sorry I have missed the start of this story. From what I have 
picked up your scooter suffered terminal damage due to ill-maintained 
pavements outside a health centre of all places? Could you possibly try one 
of those companies seen on the Tv, you know the 'free' solicitors who claim 
for accidents etc. After all this is a blatant example of bad maintenance. I 
wish you the best as I have to use a scooter myself keeps me independent. 
You at least want the scooter replaced with one of the same quality.

I suggested that you use the Scottish Small Claims Court system to get 
redress against the council.
This system is different from its English counterpart and is designed as, a 
simple to use, DIY claim through the Sherriff court system.

You can get forms for the claim from a Sheriff's Clerk and, I think, on 
line. Lawyers need not be involved and you can claim up to £750 plus costs.

Unfortunately the firms on TV only deal with physical injury claims.
I'm working on seeiung a solicitor next week if possible.

Brilliant. Sorry about the pain. I know the feeling well. Last
Saturday was my turn to have the emergency Doc out for pain relief. I
couldn't believe NHS24 when they said Doctor on his way.

That has been a very enlightening read. I have decided to do it that
way and will have a start when I get back from Glasgow Hospital with
daughter towards end of week. The only think I have difficulties with
is working out how much money I should claim  for 13 months stress,
confinement to house for 12 weeks i think. Plus being very nervously
when I was able to get out again. Petrol is easy to work out. also
cost of Photo paper and Coloured Ink cart. Then there is also the
painful effects on my damaged arms and a year ago I was still
recovering from a major shoulder operation on the right shoulder in
filling out their forms and typing. I drove round in the dark and the
RIP sign has gone but they missed the photograph of the original
damaged pavement taped round the top of the water hydrant, which is
the one shown in the original damaged slab. You can see the scratches
on the original pavement.
