Health and Safety at work: dogs in shops/restaurants
Morning,
I am after what the law actually says about dogs in shops/restaurants,
as opposed to the readers views on whether they should be allowed into
such establishments.
As I understand it the law, actually prohibits dogs/animals etc in
"food preparation areas". I am aware that Food Hygiene Regs changed
in 2006 and wonder if this regulation has changed.
I am well aware that there is much feeling that dogs etc should not be
allowed in such places etc etc etc, but I am trying to establish what
the law actually says.

I believe there is no absolute legal requirement to ban dogs from anywhere
that sells food , but equally they establishments have a responsibility to
maintain a hygienic environment.
If they feel that the easiest way to do this is to ban dogs then they are
perfectly entitled to do so.

Your assessment would conclude that dogs are unhygienic and should not
be in food prep areas.
In a restaurant area your assessment would conclude that a dog
wandering around would be hazardous to staff who could trip over it
whilst carrying trays of food and hot liquids. However, you might
consider the layout and room available and the rules sensibly imposed
on the behaviour and location of dogs. I know of country pubs where
locals bring in their dogs to sit by the fire and everyone's perfectly
happy.
Some slobbering, dirty, flea ridden mutts will be obvious health
hazards and likely to put customers off their food; others you may not
mind! But how to discriminate?
Either way, in addition to food safety and health and safety, there is
the Disability Discrimination Act to consider. You must allow access
to guide dogs (can't recall the up-to-date name for these at the
moment!)
There is nothing to stop you restricting them to certain areas
provided you make sure you do not discriminate against disabled people
eg putting them in a drafty lobby.

Try "guide dogs", it works quite well, but these days there is a
collective title of "assistance dogs" which would include the
aforementioned, plus hearing dogs for the deaf and dogs for the disabled.
