Possible to claim against Police.
Hi all, Been here before,
This is about an assault on my wife, where she had 4 front teeth
knocked out whilst on our property. Been through the legal channels,
where we eventually got the assailant in to court,
Eventually we had to go to crown court, where we had a pre-trial
review, then the date warn list was sent to us, But the CPS backed
down and without talking to my wife, they decided to go down the root
of "It's not in the Public's Intrest"
Done the complaints to CPS,
But this statement was in the last letter we recieved from them.
It is not the case that the CPS then simply neglected the case until
March 2006. The police officer responsible for investigating the case
wrote to Mr ****** in September 2005 indicating that he had not been
able to obtain the evidence required due to a lack of cooperation from
yourself and other witnesses and therefore the CPS file was closed.

I am still waiting for the internal memo that he sent to them in 2005.
As i was told there would be no problem in having it as it was from
the police to CPS. But now i got this email

I have had PS S**** liaise with CPS and brought back a number of items
from their file. I have spoken to Superintendent Robinson regarding
what I can release for your information as I have been informed that
the memos and internal communications are considered to be privileged
information. following my discussion I have been dirceted to West
Midlands Police Legal Services who I have spoken to today. they have
requested that I complete a summary of the events up until today and
they will make a decision on what if any information can be disclosed.
Unfortunately this report will take a few days for me to complete and
then legal services will have to assess the information before making
their decision. I am unable to offer you any time span for this
decision but will update you as soon as i get an answer.

I have not yet made a formal complaint to the IPCC. but I have spoken
with Inspector's at the station, And they have told me that the
officer has already had a disciplinary taken against him for not doing
his duty correctly.
So I have now being looking at the TORT Law, Would i have any grounds
and is it possible on the grounds of failing in his and there duty to
help a victim of crime.
So many cock ups this has had from day one.
So sorry to give it so much of a write up but it was the only way I
thought you might get some idea to what has gone on.

Sue the bloke, but by the sounds of it you need to hurry up before the three
year timeout on personal injury cases times out.
