Homebase managers come back from their hols
BUSH 28 WIDESCREEN INTEGRATED TV AND DVD RECORDER

I refer to your order for the above product and thank you for placing
an order with Homebase.co.uk
Unfortunately, there was an accidental error on the price shown on our
website for this product during the period from midnight on 27th
August to 07:00 on 28th August, which caused the product to be
advertised for 0.49 rather than the correct price of 349.99. This
error has now been rectified and in accordance with condition 4.2 of
our website terms we are writing to advise you of this problem.
We have therefore had to reject all orders placed at the incorrect
price in accordance with Condition 2.3 of our website terms and
conditions and with regret we cannot accept your order.
On behalf of Homebase, I apologise for the inconvenience caused and
can assure you that we have initiated the refund process. Any charges
that have been debited to your payment card will be fully refunded as
soon as possible.

they must be makin a bit of interest on that, are they gunna hold on to it
for a bit before they hand it over

Can't argue with that.
It's a well worded email and correctly explains how they are within their
rights to cancel.
Don't blame people for having a punt but it didn't stand much chance of
working
I'm sure this won't stop the usual rants and threats to sue or complain from
people who were well aware it was an error though

You know, I was thinking exactly the same. In fact, what's to stop a scam
company advertising product which don't exist for the "wrong" price, getting
thousands of orders, refunding them in full, but taking a couple of weeks to
do it and bagging the interest in the meantime?!?

Regardless off their terms and conditions, if they have debited your
account they have accepted your offer to pay 0.49p for it. I think you
will find that you could claim the item from them. The wording in the
terms indicates that you place the order , they check and accept and
refuse and then tell you if its going to cost more and give you the
option to accept the new price. I don't think it says we will take your
money and then say we are not going to give it to you. In previous
discussion with Trading standards they indicate that if the retailer
does not take any money from you then the contract is not complete, but
if they do then they need to honour it. If anyone who has ordered it
wants to try and push it, it could be worth it.

Yes, you are correct. Anyone who ordered the TV *could* take them to court.
Thats absolutely correct.
However, going to court, and actually winning are distinct things. Winning
in this case is somewhere about the 0% chance mark.
1 - *Everyone* knows you dont get tellys for 49p,
2 - it was not marked as a special offer, and
3 - their own T&C's *which you accept when you shop there* categorically
state when the contract comes into existence.
So, yes go to court, but only to make a fool of yourself.
And by the way, trading standards are not lawyers, and posts like yours
simply perpetuate yet another internet urban myth.
