You're lucky then. By holding your money they're only confirming the
contract.

Re: Anyone had their money back off Homebase yet?
just reading the terms and conditions again..........

section 2.........

2.3 Acceptance of your order and the completion of the contract between you
and us will take place on dispatch to you of the products ordered unless we
have notified you that we do not accept your order or you have cancelled it
(please refer to Returns and refunds).

........... they not email or told me they not accepting my order yet. is
this a good thing???

it says delivery time is 21 days........ so thats 18 days to go for
delivery!!!!!!

Heard on radio that it's a no no I'm afraid. They are merely citing an

      Bush TV/DVD combi (Product No: 536/1108)

      I refer to your order for the above product and thank you for placing
an order with Argos.co.uk

      Unfortunately there were was an accidental error on the price shown on
our website for this product during 27th August causing the product to be
advertised for 0.49 rather than the correct price of 349.99. This error
has now been rectified and in accordance with Condition 4.2(b) of our
Website terms and conditions I am writing to advise you of this problem.

      We have therefore had to reject all orders placed at the incorrect
price in accordance with Condition 2.3 of our Website terms and conditions
and with regret we cannot accept your order.

      On behalf of Argos I apologise for the inconvenience caused and can
assure you that any charges debited to your payment card, will be fully
refunded as soon as possible.

      Thank you again for your custom with Argos.

      Yours faithfully,

Are you implying that they're a bit fick?

Anyway, no matter - I haven't received any bad news from Homebase yet, so
I'm still trusting in my lucky bones. If they let me down I'll break a
couple of 'em to punish them for lying.

I assume that you missed the numerous newspaper articles about them getting
10,000 orders, some people making orders of several hundred sets (greedy
greedy) and them cancelling all the orders.

I'm afraid I gave up reading newspapers quite some time ago - and I've been
noticeably happier since I did.

As for my television set - as of this date & time, I've still not received
any notice that my order has been canceled, so my lucky bones might yet
succeed.

It's all about Positive Thought and I'm giving the matter a great deal of
positive energy - even now, I can visualise the warehouse staff loading my
box into the van for delivery, it's over there, on the right, next to a
glass dining table and a couple of toasted sandwich makers...

Just got mine about a minute ago - seems like it's taking them several days
to send all the emails.

Alas! - the delightfully named, Mari-Ann, has just conveyed to me her great
sorrow at being unable to provide me with the television set at the
advertised price of .49p (I hadn't realised that it had a built-in DVD
recorder!, Damn!)

I blame all those who ordered hundreds of the things! - it was all bound to
end in tears.#

As it is, I now have no choice but to punish a couple of the bones that told
me I would receive my bargain - which ones to break, that's the dilemma.
I'll probably fracture a toe and a finger - that'll teach 'em to lie to me.

Right....where's that hammer?....

Re: Anyone had their money back off Homebase yet?
Here's my reply to them..! I'm wanting my telly!!!

<snip!>

I would refer you to the Sale of Goods Act 1979 and as amended 2002, which
clearly states that traders must sell goods that are as described and of
satisfactory quality.

The television and DVD combination was clearly advertised on sale at 0.49
and
your website categorically confirmed that the price was an "internet only
offer" had not been reduced.

Under the Sale of Goods Act, it is an offence for a vendor to:

sell goods which are unsafe;
give a false description of the goods;
give a false description to the services he is providing;
* advertise a misleading price *

In addition, consumers are awarded additional protection under the Consumer
Protection (Distance Selling) Regulations 2000, in particular:

The right to clear information, including:

.. An accurate description of the goods or services
.. The price, along with any taxes and delivery charges if relevant
.. Payment arrangements

By accepting payment from myself you have entered into a valid contract to
supply the goods to me as advertised and at the price quoted. I therefore
expect the items I have ordered to be sent to me at the agreed price.

<end snip!>

give it up do you think you will win against homebase , i doubt it.

You and others of the same ilk are a mirror of British gullibility and
stupidity, it proves time and again how
powerless and weak the average consumer is, while those of us of superior
intelligence laugh in the shadows as we rake in their hard earned cash

the SOGA? They have to give you your money back. Go get a clue.

Strangely enough that response did very little to convince me of that.

Still, in fairness you did say "some of us", which leaves room for
interpretation that you are not one of the "us" :)
