Re: I'm going to love love my Sainsbury's Tele!
While we try to ensure that all prices on our website are accurate, errors
may occur. If we discover an error in the price of goods you have ordered we
will inform you as soon as possible and give you the option of reconfirming
your order at the correct price or cancelling it. If we are unable to
contact you we will treat the order as cancelled. If you cancel and you have
already paid for the goods, you will receive a full refund.
Good luck!

Re: I'm going to love love my Sainsbury's Tele!
I have also ordered one, and they have took my cash from my card today. I
don't think we will get them, as thousands have been ordered.
We will wait and see what they will offer in compensation as a PR stunt, has
anyone informed the papers yet, they love stories like these, I would expect
a email of cancelled order and maybe a free delivery offer on anything
ordered in the future maybe.
Probably not until after the bank holiday, as they have already took the
funds they will pocket a fair bit of interest in the few days they have the
money.

I looked at the Homebase site. It says Brands: Bush(7), yet when I select
'Bush', it only lists 6 televisions, and none of them fits the description.
Perhaps the offer has been hastily removed? A shame really, I wouldn't mind
a 0.49 integrated 28" telly.

Goto sound and vision, then integrated digital tv, then sort list by price,
lowest first.

What's it got to do with Sainsbury's? They sold Homebase more than a decade ago.

Yep, it has been.. But apparently someone else looked in the T&C's and it
says some price errors may occur, and to resolve this they can re credit the
cards.. or something..

Nothing to do with T&C's. Companies can't alter/over ride legislation as
they please. However the law isn't on our side in these type of cases
anyway, as Walter B. already said in an earlier post:
//////////////////
There you go:
It's an extract from
Internet Newsletter for Lawyers March/April 2002
"It would seem that again it is possible to apply the ratio of a case
based on historical facts to the 21st Century -
The precedent was set by Hartog v Colin and Shields [1939]3 All ER 566
in which there was a pricing error where the seller thought he was
pricing per pound, but the cost was actually calculated per item.
The Court held that the purchaser could not reasonably have supposed
that the offer expressed the real intention of the person making it,
and must have been aware it was a mistake. The purchaser therefore did
not, by his acceptance of the offer, make a binding contract with the
seller.
This would give an online retailer a defence if the price of a product
was so ludicrously low that the intention to create legal relations
could not be formed. "

Christ, not this again.
so I guess eBuyer really did issue Samsung widescreen tellies to buyers
for pennies. And that any court would side with the customer on a
clearly ludicrous price error.
Laws are open to interpretation. And common sense.
Try suing Homebase when the refunds come through. The judge would laugh
it out.

So in reality, what is the chance of me actually getting one of these for
the price that they quoted?
Do I have more chance of waking up with 20 million in cash on my bed and
surrounded by wonderful women?
They have sent me the above confirmation mail and debited my card also.

They will probably not have debited your card, just reserved that amount
in case the sale should go ahead, so it will show as missing off your
available amount of credit/debit. This is to stop you ordering something
else after, then not having the funds available for the first purchase.

Nope even that chance sounds just as ludicrous.
Unless you know some really wealthy people, do the lottery or just plain
wealthy yourself I think both chances are very close to nil. Maybe in your
wildest dreams :-)
Either way looks like a sad bank holiday for you!

There are so many pricing errors these days that I really doubt any papers
would be interested. It was very obviously a mistake, nobody could possibly
expect something like this to really be for sale at that price.
Therefore, to expect something in return is IMHO unfair. Yes, they may have
your money for a few days, but they also may have only ringfenced it, so it
might not actually have left your account. Even if it had, it's your own
fault. You must have know that this could not be genuine, so you were
trying to exploit an error, so if you lose some interest on your money then
IMHO you deserve it.
There have been so many instances of this where something has been priced
wrongly and everyone is kicking and screaming when they don't receive it and
threatening some kind of legal action. How would you feel if you sold
something and got the price wrong? Imagine how you would feel if you put
something on a buy it now auction on ebay for 10 when you meant 100 and
someone held you to that contract. Now multiply that by a lot of people who
read that you've mispriced your item and you've got 100 to sell. You
wouldn't be very happy and would probably be well out of pocket. Companies
cannot afford to honour mistakes like this and the public should not expect
them to.
Don't get me wrong, I love a bargain (hence I am on this newsgroup) and if I
could get a tv for that price I probably would. I didn't place an order for
this one though as I knew it was a mistake and didn't want the potential
hassle of waiting to get a refund.

I think it's a feeling of getting back at large faceless corporations by
any opportunity to turn the table on them. If you make a similar mistake
against a corporation, e.g. an investment error, then there will be no such
mercy. If your bank account is overdrawn by 1 pence, you will be penalised,
charged, overcharged, mugged, robbed, dipped in feather and tar and a receive
a letter costing 30.

No idea, but you can be sure they'll cover situations like this. Ever since
the Kodak camera "event", on-line retailers are very aware of the
consequences of pricing errors.

Homebase R Us
I've already emailed the company back (as have at 10 other people I know),
claiming that the company is in material breach of the Distance Selling
regulation by advertising what they now claim was a misleading price.
I'm sticking to my guns on this one - as should we all - not for greed's
sake but to get some recourse from one of these multi-national faceless
corporations who have been ripping us off for years with over-inflated
prices. Has anyone actually complained enough to get their TV yet?
There was no direct link, I heard it all started by a telephone call from an
employee working in the Midlands somewhere.. It must have snowballed from
there!
I'm sure there's a solicitor / lawyer out there looking through the legal
books right now!

Don't you have anything better to do with your time?
Legislation says that if the price is obviously wrong, then the retailer
doen't have any legal obligation to supply the goods at that price.

really you wont win, how sad that youre pursuing such a worthless case in
the faint hope of getting a cheap tv.
A psychologist would deduce that youre desperate to protect his lifestyle
and
obsessive tendencies. This is clearly a cry for help.
This whole sorry lets get homebase and see if we can crew them out of a
cheap tv is a mirror of British gullibility and stupidity, it proves time
and again how
powerless and weak the average consumer is, while those of us of superior
intelligence laugh in the shadows as we rake in their hard earned cash

You describe by posts, and therefore your opinions are ignorant and
pointless. Common behaviour of a person that is so damned big headed that
they think are right about absolutely everything, have no listening
skills, does not learn or shift from their point of view. This, an ideal
venue for such a breed where, instead of storming off in a huff, you
simply snip the views of others as if only yours are of any worth

Ah, but what would you suggest we say?
They took the money from my barclaycard, it's actually showing as a
debit against my account now, but they've sent me the e mail in the
meantime to say it was a pricing error.

I'm sure there aren't. The cost of a solicitor's fees and potential court
costs would probably come to far more than the full price of that (IHMO, low
