Opening packaging in shops

Assuming that one intends to pay for an item in a shop, what - if
anything - is the problem with opening an item's packaging before paying
for it?
What is it about opening the packaging that is *legally* different from
removing the item from the shelf and handling it without explicit
permission?

I was taken to court by a builder in 2006 but I issued a counterclaim.
I won the case and the judge ordered him to pay me about ¡ê1,800.
He went to the Court of Appeal but has now been refused permission to
appeal.
In the interim, he has made himself unemployed and receives

We had a new central heating boiler installed in June 2007. The
